Terms of Service — Radiax Development

These Terms of Service ("Terms") govern your use of mobile applications and related services ("Services") provided by Radiax Development ("we," "us," or "our"). By downloading, accessing, or using our Services, you agree to these Terms. If you do not agree, do not use the Services.

Eligibility

You must be at least 13 years old to use our Services. If you are under 18, you represent that you have your parent or guardian's permission to use the Services.

Some features require an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately of any unauthorized use.

Use the Services to generate harmful, abusive, or illegal content
Interfere with or disrupt the integrity or performance of the Services

AI-Generated Content

Our language learning apps use artificial intelligence to provide exercises and feedback. AI-generated content may contain errors and is provided for educational purposes only. It does not constitute professional language instruction, translation services, or certified assessment. You are responsible for verifying important information independently.

User Content

You retain ownership of content you submit through the Services (such as written responses or audio recordings). By submitting content, you grant us a limited license to process, store, and use that content solely to provide and improve the Services, as described in our Privacy Policy.

Subscriptions and Payments

Some features may require a paid subscription. Purchases are processed through the Apple App Store and are subject to Apple's terms and refund policies. Subscription pricing, billing periods, and renewal terms are displayed at the time of purchase. You may manage or cancel subscriptions through your Apple ID account settings.

Intellectual Property

The Services, including all software, design, text, graphics, and other content (excluding your User Content), are owned by Radiax Development and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial learning purposes.

Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT LEARNING OUTCOMES WILL BE ACHIEVED.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RADIAX DEVELOPMENT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED US DOLLARS ($100), WHICHEVER IS GREATER.

Termination

We may suspend or terminate your access to the Services at any time for violation of these Terms or for any other reason with notice where practicable. You may stop using the Services at any time and delete your account through the app or by contacting us.

Changes to Terms

We may modify these Terms at any time. We will post updated Terms on this page and update the "Last updated" date. Material changes may also be communicated through the app. Continued use after changes constitutes acceptance.

Governing Law

These Terms are governed by the laws of the United States and the state in which Radiax Development operates, without regard to conflict of law principles. Any disputes shall be resolved in the courts of that jurisdiction, except where prohibited by applicable consumer protection laws.
